Hard Enduro World Ranking (HEWR)

Scope and purpose
The Hard Enduro World Ranking (HEWR) is an independent, privately organized rating system in the legal form of a limited liability company under Austrian law. It serves to rank hard enduro events and athletes at the international level.
The sole purpose of the HEWR is to

to enable sporting comparability,

transparent presentation of performances, and
-
editorial and statistical processing of hard enduro sports.
The HEWR is not an event, an umbrella organization, or a sovereign or sports law organization.
By submitting a registration to the HEWR, the submitter acknowledges these terms and conditions as binding.
HEWR GmbH reserves the right to evaluate publicly available results from enduro motorcycle events and to publish them independently, objectively, and without bias.
The events are identified and evaluated according to internal, transparently applied criteria. These are based on assessments by an independent riders' organization, partners from the motorcycle industry, and independent organizers of enduro motorcycle racing. Publication is editorially independent and without any economic, organizational, or legal ties to individual events. Any attempt to influence the result by riders or organizers participating in HEWR is prohibited.
The inclusion or evaluation of an event does not create a contractual relationship or a relationship of agency, participation, or representation between the organizer and HEWR.

Participation in the ranking
Riders
Only events are considered within the scope of the HEWR. Organizers can submit their competitions independently for consideration, provided that they are classified by the HEWR as relevant in terms of sport and content. A separate registration or declaration by individual riders is not required for this. By holding an event that is considered for inclusion, the respective organizer agrees that the officially published results will be evaluated and published within the framework of the HEWR.
Organizers
Organizers can register their competitions for consideration or be included editorially a, provided they meet the minimum sporting criteria. There is no legal right to inclusion.
Regardless of this, the HEWR reserves the right to also consider publicly available results from events that have not been actively submitted, provided that these are classified as athletically relevant and meaningful for an overall evaluation according to uniform internal criteria.

The HEWR is based on a weighted evaluation system that takes into account the following criteria, among others:

The specific calculation method may be further developed and does not constitute a legal claim.

Titles and designations
The title
"Hard Enduro World Champion (HEWR)"
denotes the highest-ranked rider in a defined scoring period within the Hard Enduro World Rankings.
This title

is an editorial award within the HEWR system and

does not establish membership in any association,
-
does not replace any national or international championship titles,
-
is independent of existing sports organizations,
-
does not establish any sporting authority or legal status.

Changes, further development, adjustments
The HEWR is subject to ongoing development. HEWR GmbH reserves the right, in particular, to

adjusting evaluation models,
-
change weightings,
-
redefine categories,
-
add or remove events,
-
independently evaluate publicly announced events and their results according to internal criteria, enter them into the system, and publish them.
Any changes shall be made in an objective, comprehensible, and transparent manner. They shall apply exclusively to future evaluation periods and shall have no retroactive effect on evaluation periods that have already been completed.
Evaluation periods relating to the previous calendar year and the corresponding annual evaluation are considered to be completed.
No legal claims can be derived from previous regulations or evaluations.

Disclaimer
HEWR is a purely editorial and statistical system. There is no liability whatsoever towards participants. In particular (but not limited to), no liability is accepted for:

events,

their organization or implementation,
-
security measures,
-
results or evaluations by third parties,
-
damage, accidents, or injuries in connection with events.

Other consequences of a rating
liable.
Participation in events is entirely at your own risk and subject to the respective regulations of the organizing organizations.

Data processing, reporting, and freedom of expression and media
For the purpose of maintaining, documenting, and publicly presenting the ranking, HEWR processes personal and factual data of drivers, in particular:

Team or manufacturer affiliations

Publicly available information

Image material related to events
Processing and publication are based on legitimate interest pursuant to Art. 6 (1) (f) GDPR and in compliance with freedom of expression and media freedom pursuant to § 1 Media Act (MedienG). The purpose is to provide factual, truthful, and comprehensible reporting on international hard enduro sport and its sporting development and classification.

Regardless of any organizational, contractual, or economic connection to HEWR, results, information, and images from events may also be taken into account and published, provided that they have been made publicly available or lawfully published by the respective organizers or rights holders (e.g., via results lists,press releases, or official communications).
HEWR processes only those data that are necessary for factual journalistic reporting, sporting evaluation, and transparent presentation, while safeguarding the legitimate interests and privacy of the persons concerned.
Further information on the purpose, scope, and legal basis of data processing, as well as on the rights of data subjects (in particular, information, correction, restriction, or objection) is regulated in the currently valid privacy policy.

Image, sound, and media rights
Organizers who voluntarily participate in the HEWR provide the HEWR and its partners with image, audio, and film material created in connection with their event or made available by them free of charge for editorial use.
This use serves the purpose of public presentation, increasing reach and visibility, and sustainably strengthening the brand value of HEWR and the participating events.

Editorial contributions

Archiving and documentation purposes
The granting of rights of use is non-exclusive and unrestricted in terms of time, space, and content within the scope of the aforementioned purposes.
Publication is based on legitimate interest pursuant to Art. 6 (1) (f) GDPR and freedom of the media and reporting.
Revocation is possible in principle, provided that this does not conflict with any overriding legitimate interests, in particular those of ongoing reporting, documentation, or publications that have already been made.
Participants are liable for ensuring that the image, audio, and film material provided is free of third-party rights and shall indemnify and hold HEWR harmless for any claims.

No entitlement to inclusion or placement – editorial freedom and data protection
There is no legal claim to

inclusion in HEWR,
-
a specific placement,
-
a specific number of points, or
-
a mention by name, image, or content does not exist.
HEWR is an editorially managed, independent ranking. The selection, evaluation, weighting, presentation, and commentary on events, results, and content are carried out within the framework of constitutionally protected freedom of expression and media freedom in accordance with § 1 of the Media Act.
The processing of personal data and event-related information is therefore also based on legitimate interest in accordance with Art. 6 (1) lit. f GDPR in conjunction with media privilege. This interest lies in particular in the journalistic documentation, classification, and reporting on international enduro motorcycle racing, as well as in public information and archiving. Editorial activities also include the use of publicly available information, results, and image and text sources and their journalistic processing. There is no entitlement to specific content, forms of presentation, evaluations, or publications.

Final provisions
Should any provision of these regulations be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Austrian law applies exclusively, excluding referral provisions.
The place of jurisdiction is Vienna, Austria, to the extent permitted by law.
